By accessing or using Velocity by CalcMenu ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

These Terms apply to all users of the Service, including administrators, managers, and viewers within your organization.

2. Description of Service

Velocity is an electronic buffet label management system that enables hospitality organizations to:

• Manage digital buffet labels and electronic shelf labels (ESL)
• Create and schedule events with dish assignments
• Display allergen information and nutritional data
• Coordinate label updates across multiple outlets and properties

3. Account Registration

To use our Service, you must:

• Be authorized by your organization to access the Service
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Promptly notify us of any unauthorized use of your account

You are responsible for all activities that occur under your account.

4. Acceptable Use

You agree NOT to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to any part of the Service
• Interfere with or disrupt the Service or servers
• Upload malicious code, viruses, or harmful data
• Share your account credentials with unauthorized individuals
• Use the Service to store or transmit infringing or illegal content
• Reverse engineer or attempt to extract the source code

5. Intellectual Property

The Service and its original content, features, and functionality are owned by CalcMenu and are protected by international copyright, trademark, and other intellectual property laws.

You retain ownership of any content you upload to the Service (dishes, menus, events). By uploading content, you grant us a license to use, store, and display that content as necessary to provide the Service.

6. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

You are responsible for ensuring that any personal data you upload to the Service (such as employee names or contact information) complies with applicable data protection laws.

7. Service Availability

We strive to maintain high availability of the Service, but we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to:

• Scheduled maintenance (we will provide advance notice when possible)
• Emergency repairs or security updates
• Factors beyond our control (network issues, third-party service outages)

8. Third-Party Integrations

The Service integrates with third-party services including:

• ZKONG: Electronic shelf label hardware and cloud platform
• Google/Microsoft: Authentication services
• Supabase: Database and backend services

Your use of these integrations is subject to their respective terms and policies.

9. Limitation of Liability

To the maximum extent permitted by law, CalcMenu shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, data, or business opportunities
• Damages resulting from service interruptions
• Damages from unauthorized access to your data
• Errors in label content or display

10. Indemnification

You agree to indemnify and hold harmless CalcMenu and its officers, directors, employees, and agents from any claims, damages, or expenses arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Content you upload to the Service

11. Termination

We may terminate or suspend your access to the Service immediately, without prior notice, for any reason, including breach of these Terms.

Upon termination, your right to use the Service will cease immediately. Provisions that by their nature should survive termination will survive.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Last updated" date.

Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Switzerland, without regard to its conflict of law provisions.
